Why loft conversions are notifiable
Most loft conversions in terraced and semi-detached London homes involve building directly onto, or cutting into, the shared party wall. Where your works touch the neighbour’s structure, you have a legal duty to serve notice before starting. The Act exists to prevent and resolve disputes, and serving valid party wall notices is the first formal step.
Typical loft works that engage the Act
- Steel beams and RSJs bearing into or onto the party wall to support the new floor and roof structure — a classic Section 2 activity.
- Cutting pockets into the party wall to seat steels, or inserting flashings and trays.
- Chimney breast removal within the loft, where the breast forms part of the party wall.
- Dormer construction that abuts or is built off the party wall, including raising or rebuilding the parapet.
- Roof works where a party wall is raised, underpinned or weatherproofed.
Which notices apply
The type of notice depends on the works. Cutting in beams, raising the wall or removing a chimney breast fall under Section 2, requiring a party structure notice served at least two months before works begin. Neighbour considerations in London terraces
In tightly packed London streets, one party wall is often shared with two neighbours, and each adjoining owner must be served. Once served, a neighbour has 14 days to consent or dissent. If they consent in writing, no surveyor is required for that element, though a schedule of condition is still strongly advisable. If they dissent, or simply do not reply within 14 days, a dispute is deemed to have arisen and surveyors are appointed. The parties may agree a single ‘agreed surveyor’, or each appoint their own; a third surveyor is selected to resolve any deadlock.
Protecting everyone with a schedule of condition
Before steels go in, we prepare a photographic schedule of condition recording the neighbour’s property. This provides an impartial baseline so that any alleged damage — cracking around cut pockets, for example — can be fairly assessed. It is one of the most valuable safeguards for both building owners and adjoining owners.
The award
Where surveyors are appointed, they produce a party wall award. This document sets out the agreed works, working hours, access arrangements and the schedule of condition, and confirms who pays. FAQs
Do I need a party wall notice for a Velux-only loft?
If your conversion only adds roof windows and does not touch, cut into or load the party wall, notice may not be required. However, most habitable conversions involve steels into the wall, which are notifiable.
What if my neighbour ignores my notice?
Silence is not consent. If no reply arrives within 14 days, a dispute is deemed to have arisen and the process moves to the appointment of surveyors, so your project can still proceed lawfully.
How long before works can I serve notice?
A party structure notice under Section 2 must be served at least two months before the works start, so it is wise to plan early in your design programme.
