What Is an Expert Witness? A Surveyor’s Role Explained

An expert witness is a specialist whose knowledge lets them give opinion evidence to a court — something ordinary witnesses cannot do. In property and construction disputes, that specialist is usually a chartered surveyor: someone who can tell the judge whether the crack in your wall was caused by next door’s basement dig, whether a party wall award was validly made, or where a disputed boundary truly runs.

What makes someone an expert witness?

Three things: recognised expertise (qualifications plus real practice), independence, and compliance with the court rules — in England and Wales, Civil Procedure Rules Part 35. The expert’s overriding duty is to the court, not to whoever pays them. A report must set out instructions, facts, reasoning and a statement of truth; a partisan “hired gun” report is worse than none.

What does a surveyor expert witness actually do?

  • Inspects the property and gathers measured, photographic evidence
  • Analyses the issues against legislation, case law and RICS guidance
  • Produces a CPR 35 compliant expert witness report
  • Answers written questions, meets the other side’s expert and prepares joint statements
  • Gives oral evidence at trial, arbitration or adjudication if required

When would I need one?

Typical triggers: damage after a neighbour’s works with causation disputed; challenges to a party wall award or surveyor conduct; boundary disputes heading to court; and defective building work claims. Courts increasingly favour a single joint expert instructed by both sides to keep costs down.

What does an expert witness cost?

Hourly rates for surveyor experts in London typically run £150–£300, with full CPR 35 reports from roughly £1,500. A clear fee estimate should always precede instruction.
